Terms and Conditions regarding the placing of orders and the handling of credit card payments by Eat Now.

The Contract Between You And The Restaurant .

  1. Eat Now is authorized to take payment directly from users of the www.eatnowbrighton.co.uk web site when they place orders with restaurants.
  2. Payment is taken directly by Eat Now rather than by the restaurant itself, however upon placing an order with a restaurant, a contract is formed between you ("the Purchaser") and the restaurant ("the Vendor"). Eat Now is acting as an agent of the Vendor. Our role is limited to facilitating the transaction between the parties. The Vendors provide Eat Now with a commission on each order for fulfilling this role on their behalf, and Eat Now does not derive any other income from orders which are placed by Purchasers, nor is Eat Now involved in any other aspect of the contract between a Vendor and a Purchaser.
  3. Should our customers be dissatisfied in any way with the goods and services delivered following an order placed via the Eat Now web site or in the event of any disputes in connection with the fulfillment of such an order the customer is required to take up the matter with the Vendors. We emphasize the contract is between the vendor and the purchaser, we are purely acting as an agent.
  4. Customers of the Eat Now website are required to be 18 years of age.
  5. Eat Now hereby disclaims any liability in connection with the processing of orders unless it is clearly shown that the problem was caused by an error or negligence on the part of the Eat Now website, in processing a Purchaser's order and forwarding it to the Vendor.

The Processing And Storage Of Credit Card Data

Using PayPal Eat Now is authorised to take payment from Purchasers directly on behalf of the Vendors this avoids us having to pass on any details of customers' credit cards to the Vendors and is therefore a more secure arrangement.

Eat Now does not store the credit card details of Purchasers who are private individuals when they place orders with Vendors via the Eat Now.com web site. Such credit card transactions are carried out using the services of PayPal and only transaction codes are retained.

Other Terms and Conditions

When receiving an order containing alcohol, the following T&C's are mandatory due to licencing regulations:

  • Strictly over 18's, may order or receive an order containing alcohol, and alcohol will only be delivered to the person who has placed the order.
  • If ordering alcohol, recipients will be checked for id on delivery. ID is required in all cases, so please have it ready, and please don't be offended when our drivers ask to see it. We operate a 'Challenge 25' policy whereby any person attempting to buy alcohol who appears to be under 25 will be asked for photographic ID to prove their age.
  • The only forms of ID that will be accepted are passports, driving licences with a photograph or Portman Group, Citizen Card or Validate proof of age cards bearing the 'PASS' mark hologram.
  • It is illegal to pass alcohol on to minors. If we believe the alcohol will be passed to under 18's sale will be refused.
  • Customer must be seen coming from the property to which the delivery is being made.
  • You must give full address including CORRECT postcode.
  • We will not deliver alcohol to public places such as parks, or road sides.
  • You must give a contact telephone number.
  • Verbal and physical abuse or intimidation of any kind towards our staff will not be tolerated. If you are deemed to be abusive in any way, your details will be passed on to the police and the given address will no longer be eligible for delivery.
  • If you sound intoxicated, sale will be refused.
  • If you do not meet any of the above conditions sale will be refused.
  • If the above conditions are not met, or ID is not produced when requested, the driver is instructed to drive away. You may still be charged for your order, and Eat Now will not be obliged to refund any payment in such circumstances.
